General Terms and Conditions for Customers of LEHMON

Welcome to LEHMON! Below you will find the general terms and conditions that apply to all purchases you make on our website. By placing an order, you agree to these terms and conditions.

In these general terms and conditions, the following definitions apply:

Merchant: LEHMON

Consumer: A natural person who does not act in the course of a profession or business and enters into a distance contract with LEHMON.

Distance contract: A contract concluded within the framework of a system organized by LEHMON for distance selling of products and/or services, up to and including the conclusion of the contract, exclusively through one or more means of distance communication.

Means of distance communication: Any means that can be used to conclude a contract without the consumer and the merchant being physically present in the same space.

Cooling-off period: The period within which the consumer can exercise his right of withdrawal.

Right of withdrawal: The consumer's possibility to withdraw from the distance contract during the cooling-off period.

Day: Calendar day

Continuous transaction: A distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.

Durable data carrier: Any medium that allows the consumer or merchant to store information addressed to him personally in a way that enables future access and unaltered reproduction of the stored information.

1. Applicability

These general terms and conditions apply to every offer from LEHMON and to every distance contract concluded between LEHMON and the consumer.

Before the distance contract is concluded, the text of these General Terms and Conditions is made available to the consumer. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions are available for inspection at LEHMON and will be sent to the consumer free of charge as soon as possible upon request.

If the distance contract is concluded electronically, in deviation from the previous paragraph and before the distance contract is concluded, the text of these general terms and conditions can be made available to the consumer electronically in such a way that it can be stored easily by the consumer on a durable data carrier. If this is not reasonably possible, it will be indicated before the distance contract is concluded where the general terms and conditions can be accessed electronically and that they will be sent to the consumer electronically or in another way free of charge upon request.

In case specific product or service conditions also apply alongside these general terms and conditions, the second and third paragraphs apply mutatis mutandis, and in case of conflicting general terms and conditions, the consumer can always rely on the applicable provision that is most favorable to him.

2. Orders:

2.1 Placing an order: By placing an order, you declare that you are at least of legal age to make online purchases.

2.2 Accuracy of information: Ensure that all information you provide when placing an order is accurate and complete. We are not responsible for any delays or issues due to incorrect information.

2.3 Order confirmation: After placing an order, you will receive an automatic confirmation email with the details of your order. This is not an acceptance of your order; it is simply a confirmation that we have received your order.

2.4 In case of late payment by the customer or in case of problems with payments of previous orders, LEHMON reserves the right to dissolve the agreement.

3. Price and Payment:

3.1 Price: All prices on our website are stated in euro and include taxes, unless otherwise indicated.

3.2 Payment: Payment can be made via the available payment methods on our website. You are responsible for all costs associated with the payment transaction.

4. Delivery:

4.1 Shipping information: See our shipping policy for information on shipping costs, methods, and times.

4.2 Risk of loss: The risk of loss and damage to the products passes to you at the time of delivery.

5. Returns and Exchanges:

5.1 Return policy: Refer to our return policy for information on returning and exchanging products, including the conditions and procedure for returns.

6. Intellectual Property:

6.1 Copyright: All content on our website, including but not limited to images, text, and logos, is protected by copyright and other intellectual property rights. It is not permitted to copy, reproduce, or distribute this content without our express permission.

7. Limitation of Liability:

8.1 Jurisdiction: These general terms and conditions are governed by and interpreted in accordance with the laws of Belgium.

10. Force Majeure

In case of force majeure, we, LEHMON, are not obliged to fulfill our obligations. In that case, we can either suspend our obligations for the duration of the force majeure or definitively terminate the agreement.

Force majeure includes any circumstance beyond our control that wholly or partially prevents us from fulfilling our obligations. This includes, among other things, strikes, fire, business disruptions, power outages, disruptions in (telecommunications) networks or connections, or communication systems used, as well as the website not being available at any time, and non or untimely delivery by suppliers or other third parties engaged.

11. Complaints procedure

If you have a complaint about our services and/or products, you can contact us at contact@lehmon.com. We aim to handle your complaint within 14 days. If the processing takes longer than 14 days, you will receive a response from us indicating when you can expect a more detailed answer.

Complaints must be submitted to us within a reasonable period of time, fully and clearly described, after you have discovered the defects.

Only Belgian law applies to all agreements we conclude with our customers, regardless of their place of residence. In case of disputes, only the competent Belgian courts are authorized. If, for reasons of international law, a different law is applicable, Belgian Market Practices and Consumer Protection Act will be primarily referred to in the interpretation of these general terms and conditions.
